1. Acceptance of These Terms

By accessing or using bighornremodeling.com (the "Website"), submitting a form, calling or texting the phone number listed on the site, emailing us, or otherwise interacting with Big Horn Remodeling through the Website, you agree to these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Website or submit information through it.

2. About Big Horn Remodeling

Big Horn Remodeling is a licensed Nevada general contractor (Nevada State Contractors Board B-2 General Building License #0091383), based at 2620 Regatta Drive, Suite #102, Las Vegas, NV 89128. We are licensed, bonded, and insured. We provide residential and commercial remodeling, permit services, and related construction work throughout the Las Vegas Valley and Clark County, Nevada. The qualifier on the license is Nathan Nehoraoff.

3. Use of the Website

You may use the Website to learn about our services, see examples of our work, find our contact information, and request a free consultation or estimate. You agree to use the Website only for lawful purposes and not to:

  • Use the Website in a way that violates federal, state, or local law;
  • Submit false, misleading, or fraudulent information through any form on the Website;
  • Attempt to interfere with the Website's operation, security, or performance;
  • Scrape, copy, or systematically extract content from the Website without our written permission;
  • Use the Website to harass, threaten, or harm any person.

4. Website Content Is Informational - Not a Contract or Binding Offer

Nothing on this Website is a contract. Any pricing, timeline, project description, or scope referenced on the Website is illustrative only and is not a binding offer to perform work on any specific project. Actual project pricing, scope, and timeline are determined only after a field walk and a separately signed written agreement.

Photographs, project descriptions, cost ranges, timeline estimates, FAQs, and similar content on the Website are provided for informational purposes only. They reflect general experience from past Big Horn projects in the Las Vegas market and are not a guarantee that your specific project will run at the same cost, timeline, or scope.

Under Nevada law, every residential construction contract Big Horn enters with a homeowner must meet the requirements of Nevada Revised Statutes Chapter 624, including but not limited to NRS 624.940. A binding agreement for work on your property exists only when:

  • We have conducted a field walk and documented the scope;
  • We have prepared a written contract identifying the scope of work, price, timeline, and required disclosures;
  • Both you and Big Horn Remodeling have signed that contract; and
  • Where applicable, the contract complies with NRS 624.940 and the required NRS 624.600 disclosure form has been provided.

Submitting an inquiry through the Website, requesting an estimate, or receiving a verbal price range over the phone does not by itself create a contract for construction work.

5. Calls, Texts, and Communications Consent (TCPA)

When you provide your phone number to Big Horn Remodeling - through a form on the Website, in an email, in a text message, or in a phone call - you expressly consent to be contacted by Big Horn Remodeling at that number by phone call and by text message regarding your inquiry, your project, your prior business with us, or matters reasonably related to those topics. This consent is specific to communications from Big Horn Remodeling and is not extended to any third-party marketing partners or affiliates.

Big Horn Remodeling does not send mass marketing or promotional text messages. Our communications are project-specific or inquiry-specific.

Your right to opt out: You may revoke your consent to receive calls or texts from Big Horn Remodeling at any time, in any reasonable manner. The easiest way is to reply STOP to any text message we send you. You may also tell us to stop calling or texting by replying to any email, by saying so on a phone call, or by emailing nathan@bighornremodeling.com. We will honor your revocation in accordance with applicable law, including the Federal Communications Commission's rules under the Telephone Consumer Protection Act (47 C.F.R. § 64.1200). Standard message and data rates from your carrier may apply to any text messages.

6. Accessibility

Big Horn Remodeling is committed to making the Website accessible to people with disabilities, and we work toward conformance with the Web Content Accessibility Guidelines (WCAG) 2.1 Level AA published by the World Wide Web Consortium. We regularly review the Website for accessibility issues and make improvements as we identify them.

7. Intellectual Property and Use of Content

The Website, including all text, photographs, project photos, graphics, logos, design elements, video content, and the Big Horn Remodeling brand and trademarks, is owned by or licensed to Big Horn Remodeling. The Website content is protected by United States and international copyright, trademark, and other intellectual property laws.

You may view, share, and print Website content for your personal, non-commercial use. You may not, without our prior written permission:

  • Reproduce, republish, or redistribute Website content for commercial purposes;
  • Use Website photographs in any commercial materials of your own;
  • Remove copyright, trademark, or other proprietary notices from Website content;
  • Use Big Horn Remodeling's name, logo, or marks in a way that suggests sponsorship or endorsement we have not given.

If you believe any content on the Website infringes a copyright you hold, you may submit a notice under the Digital Millennium Copyright Act (DMCA) to the contact information at the end of these Terms.

8. Information You Submit Through the Website

When you submit information to Big Horn Remodeling through a Website form or by emailing us - including your name, contact information, project details, and any photos you choose to share - you grant Big Horn Remodeling permission to use that information for the purposes of responding to your inquiry, providing services, and operating our business, as described in our Privacy Policy.

You represent and warrant that any information you submit is accurate and that you have the right to submit it. Do not submit information that belongs to another person or that you do not have the right to share.

9. Reviews and Testimonials

The Website displays customer reviews and testimonials. We use these only when we have permission from the reviewer or where the review was publicly posted on a platform where Big Horn Remodeling is identified (Google Business Profile, Yelp, Facebook, Houzz, and similar). Reviews reflect the experience of individual customers and are not guarantees of any particular outcome for your project.

If you are a former Big Horn customer and you would like a review or photograph that identifies you to be removed from the Website, please contact us using the information at the end of these Terms and we will remove it promptly.

10. Links to Other Websites

The Website may contain links to websites operated by other companies - for example, our Google Business Profile, social media platforms, and review platforms. Big Horn Remodeling does not control those websites and is not responsible for their content, accuracy, privacy practices, or accessibility. Following a link from this Website to another site is at your own risk.

11. Disclaimer of Warranties

The Website and its content are provided on an "as is" and "as available" basis. To the fullest extent permitted by law, Big Horn Remodeling disclaims all warranties of any kind regarding the Website, whether express, implied, statutory, or otherwise, including (without limitation) warranties of merchantability, fitness for a particular purpose, accuracy, completeness, and non-infringement.

Big Horn Remodeling does not warrant that:

  • The Website will be uninterrupted, secure, or error-free;
  • Any information on the Website is current at any given time;
  • Any pricing or timeline information on the Website will apply to your specific project;
  • Any specific result will be achieved from using the Website.

This disclaimer applies only to the Website and its content. It does not modify or limit any warranties Big Horn Remodeling provides under a separate written construction contract with you, or any warranties imposed by Nevada law on the construction work itself.

12. Limitation of Liability

To the fullest extent permitted by Nevada law, Big Horn Remodeling, its owners, employees, agents, and contractors shall not be liable to you for any indirect, incidental, special, consequential, exemplary, or punitive damages of any kind arising from or related to your use of the Website, including (without limitation) lost profits, lost data, lost business opportunity, or property damage, even if Big Horn Remodeling has been advised of the possibility of such damages.

To the fullest extent permitted by law, Big Horn Remodeling's total cumulative liability to you for any and all claims arising from or related to your use of the Website (as distinguished from any signed construction contract) shall not exceed one hundred dollars ($100.00) U.S.

This limitation applies only to the Website. It does not limit any rights or remedies you may have under a separate written construction contract with Big Horn Remodeling, under the Nevada State Contractors Board complaint process under NRS Chapter 624, or under any other non-waivable consumer-protection rights you have under Nevada law.

13. Indemnification

You agree to indemnify, defend, and hold harmless Big Horn Remodeling, its owners, employees, agents, and contractors from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising from or related to: (a) your breach of these Terms; (b) your misuse of the Website; (c) any information you submit through the Website that is inaccurate, fraudulent, or violates a third party's rights; or (d) your violation of any law in connection with your use of the Website.

14. Governing Law and Venue

These Terms, and any dispute arising from or related to these Terms or to your use of the Website, are governed by the laws of the State of Nevada, without regard to its conflict-of-laws principles. Any dispute that is not resolved through the procedures described in Section 15 will be brought exclusively in the state or federal courts located in Clark County, Nevada, and you and Big Horn Remodeling each consent to the personal jurisdiction of those courts and waive any objection to venue in those courts.

15. Dispute Resolution

If you have a dispute with Big Horn Remodeling arising from or related to your use of the Website, we want to resolve it without expensive litigation if possible. Before filing any lawsuit, you and Big Horn Remodeling agree to the following process:

  • Step 1 - Written notice. The party with the dispute sends written notice to the other party describing the dispute and the relief sought. Your notice to Big Horn Remodeling should be sent to the contact information at the end of these Terms. Big Horn Remodeling's notice to you will be sent to the most recent email address or postal address we have on file for you.
  • Step 2 - Good-faith negotiation. For thirty (30) days following the notice, the parties will negotiate in good faith to resolve the dispute. Each party will make a reasonable effort to make decision-makers available for that negotiation.
  • Step 3 - Mediation. If the dispute is not resolved by negotiation, before either party files a lawsuit, the parties will participate in non-binding mediation in Clark County, Nevada, with a mediator mutually selected by the parties. Each party will bear its own costs of mediation and the parties will share the mediator's fee equally unless the mediator orders otherwise.
  • Step 4 - Litigation. If the dispute is not resolved by mediation, either party may bring suit in the courts identified in Section 14.

Nothing in this Section 15 prevents either party from seeking emergency injunctive relief in court at any time, or from filing a complaint with the Nevada State Contractors Board under NRS Chapter 624 at any time.

16. Class and Representative Action Waiver

To the fullest extent permitted by law, you and Big Horn Remodeling each agree that any dispute arising from or related to your use of the Website will be brought in your individual capacity, and not as a plaintiff or class member in any purported class, collective, consolidated, or representative proceeding. This waiver applies only to disputes related to the Website and to communications and consents covered by these Terms (such as text-messaging consent under Section 5). It does not apply to any rights you have under a separate written construction contract or under non-waivable Nevada consumer-protection law.

17. Changes to These Terms

Big Horn Remodeling may update these Terms from time to time. When we make a change, we will update the "Last updated" date at the top of this page. For material changes, we may also post a notice on the home page. Your continued use of the Website after a change becomes effective constitutes your acceptance of the updated Terms.

18. Severability and Entire Agreement

If any provision of these Terms is held to be unenforceable, that provision will be enforced to the maximum extent permitted by law and the remaining provisions will remain in full force and effect. These Terms, together with our Privacy Policy, constitute the entire agreement between you and Big Horn Remodeling regarding your use of the Website and supersede any prior agreements between you and Big Horn Remodeling regarding the Website. These Terms do not modify or replace any separate written construction contract you may sign with Big Horn Remodeling for work on your property.
